Scope

These terms cover the use of the UptimeLogger application and of this website. By downloading or using the application you accept them.

What you may do

UptimeLogger is provided free of charge. You may use it privately and commercially, on as many of your own devices as you like, without registration and without a user account.

You may not sell it or pass it on for payment, distribute modified versions, or remove authorship and origin notices. The source code is not published; reverse engineering is permitted only within the limits the law grants regardless of these terms.

No availability promise

This website, the download addresses and the application's version check are provided without any promise of availability. Development may stop at any time.

What the recording is, and what it is not

UptimeLogger writes its own record of what is measurable on your machine. It is a starting point for a conversation with your provider, not evidence in a legal sense and not an expert report. The application cannot tell whether an interruption happened in the provider's network, in your home network or on the device itself. Using the record with third parties creates no claims against the provider of this software.

Warranty and liability

The application is provided free of charge and without warranty of fitness for a particular purpose, of accuracy, or of uninterrupted availability.

Liability applies under statutory rules for intent and gross negligence and for fraudulently concealed defects. Liability for injury to life, body or health and liability under the German Product Liability Act remain unaffected. Beyond that, liability is excluded, which matches the statutory rule for items provided free of charge (sections 521 and 599 of the German Civil Code).

Backing up your data is your own responsibility.

Third-party services

The installers are hosted on GitHub, and the speed test uses a Cloudflare service when you start it. Those services have their own terms. What data is involved is described in the privacy statement.

Changes to these terms

These terms may change as the application changes or as the law requires. The version that applies is the one published here at the time of your download; the date is below.

Applicable law

German law applies. The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
